A West Chicago rape suspect who police say was caught when he tried to apologize to his accuser was back in jail Thursday.
Salvador Alvarado, 38, had been at the Elgin Mental Health Center since July when DuPage County Circuit Judge Kathryn Creswell determined he needed to undergo a psychiatric evaluation.
A mental fitness report recently concluded that increased antidepressant medication had stabilized Alvarado's mood and the case against him for the 2008 attack on a West Chicago woman could resume.
Alvarado was returned to jail after lawyers for both sides briefly met Thursday with Creswell. She also scheduled a Dec. 21 fitness hearing to discuss the new report.
Authorities accuse Alvarado of breaking into his victim's house late one night and raping her. The victim told authorities her attacker apologized almost immediately after the rape and asked if she would be his girlfriend before fleeing.
Alvarado was arrested after he showed up at the woman's house about a month later apologizing again and professing his love for her.
The woman told police she had never met Alvarado before the attack.
