Aurora's building code board of appeals Wednesday granted the city's motion to dismiss all claims made by foes of the city's new Planned Parenthood facility.

After a nearly two-hour executive session, board attorney Peter Wilson said the only matter that remains before the board is the issuance of the final occupancy permit. The issuance of that permit, he said, depends only on whether final construction punch-list items were completely addressed before final permit was issued.

The board will convene again at 5 p.m. Sept. 24 at city hall.

According to the original appeal, filed in July by the Thomas Moore Society, clinic opponents allege Aurora officials refuse to apply the correct zoning ordinance to the facility.

Those allegations were dismissed Wednesday.

The controversial clinic opened last October after an independent review found no legal basis for denying it an occupancy permit.

A current nine-count lawsuit the group filed against the city last year in DuPage County was recently assigned to Circuit Judge Kenneth Popejoy and is awaiting a hearing date.
