Aurora man charged with pointing gun at person's head, stealing woman's phone

An Aurora man has been charged with several felonies after authorities said he stole a woman's cellphone Sunday, pointed a stolen gun at a person's head and fought with a police officer.

Dwayne K. Smith, Jr., 27, of the 500 block of South Lake Street, is charged with armed habitual criminal, armed robbery, armed violence, aggravated robbery, three counts of aggravated unlawful use of a weapon, robbery, theft, possession of a firearm without a FOID card, and two misdemeanors - resisting arrest and battery, according to prosecutors and Kane County court records.

According to authorities, the attack began about 4:45 p.m. on the 600 block of Lake Street. Smith had spoken with the woman on the phone, became upset and went to her house, authorities said. When Smith arrived, he saw the woman and her friends sitting on the front porch.

Smith pointed the gun at someone, prompting the woman to begin recording what was happening on her cellphone, prosecutors said.

Smith then pressed the gun to her head, threatened her not to call police, and took the Samsung phone and ran off. When Aurora police found him a short time later, Smith fought with an officer to avoid arrest, prosecutors said.

During the investigation, Aurora police recovered the handgun and determined it had been stolen in DeKalb that day.

Judge Keith Johnson set Smith's bail at $200,000, meaning he must post $20,000 to be released from the Kane County jail while the charges are pending, records show.

Smith is next due in court Oct. 18 and faces a sentence ranging from six to 30 years in prison with no chance of probation.

The armed habitual criminal charge was triggered by convictions in two cases from February 2014 - an armed robbery in Glen Ellyn in DuPage County and the other in North Aurora Kane County.

Smith was sentenced to 10 years in prison for those two cases, court records show.
