Aurora man accused of waving firearm at party charged

An Aurora man arrested Friday faces charges after police say he displayed a gun at a party when a guest didn't let him "test drive" a car.

Erik R. Derby, 36, of Foxmoor Lane, is charged with aggravated unlawful use of a weapon, unlawful restraint and resisting arrest, according to a news release Saturday from the St. Charles Police Department.

Police said they responded at 6:48 p.m. to a home in the 1500 block of Allen Lane, where a man reportedly had a gun.

When officers arrived, several people were trying to calm Derby, who was a party guest, police said.

Derby is accused of showing the gun to another guest after he wasn't allowed to drive the guest's car. Derby followed the other guest back to the party, and to two began fighting, causing Derby to drop his gun, police said. The other partygoers restrained Derby and took his gun until police arrived, according to the release.

No shots were fired and the gun was never pointed at anyone, police said.

Although Derby had a valid firearm owner's identification card, he didn't have an Illinois concealed carry license, according to the release.

Derby was released on a recognizance bond Saturday, court records show. He is due back in court Thursday.
