Lawsuit targeting McDonald's over soda tax dismissed

CHICAGO (AP) - A Cook County judge has dismissed a lawsuit filed against McDonald's Corp. that alleged the fast-food chain taxed the tax imposed on sweetened beverages sold in the Chicago area.

In his order dismissing the lawsuit, Judge Thomas Mulroy pointed out Tuesday a sales tax was "not applied to the amount charged the plaintiff under the sweetened beverage tax."

Attorney Daniel Seidman represents plaintiff Yvan Wojtecki. He said his client's case had been voluntarily dismissed after they were convinced they were incorrect.

McDonald's franchisee Nick Karavites says a walk-through of the receipt was conducted to demonstrate double taxation hadn't occurred. Karavites says he understood "the inherent confusion" the new penny-for-ounce soda tax has created for customers.

In addition to McDonald's, Walgreens and 7-Eleven were hit with lawsuits over soda pop tax.
