Judge OKs DNA results even though testing used up sample

BLOOMINGTON, Ill. (AP) - A judge says prosecutors can present DNA evidence in a central Illinois man's sexual abuse trial even though investigators used all of a DNA sample for testing without prior notice to his attorney.

Forty-nine-year-old Richard Wichmann is charged with molesting a minor girl. Defense attorney Jennifer Patton argued that Wichmann's constitutional rights were violated because the DNA material is not available for testing by a defense expert.

But The (Bloomington) Pantagraph reports (http://bit.ly/2uxYPj9 ) McLean County Judge Scott Drazewski denied a motion Friday to suppress the DNA results after finding that the state did not violate the rules of evidence or discovery.

Drazewski ruled that scientific methods used to locate and examine DNA profiles require a minimum amount of material and sometimes those samples must be consumed in that process.
