8-year sentence for 7th DUI, drug arrest in Carpenterville

A 44-year-old Carpentersville man has been sentenced to eight years in prison after pleading guilty to his seventh DUI arrest, along with a drug possession charge while he was free on bail.

Eduardo Calleros, of the 0-99 block of Thrush Road, pleaded guilty last week to felony aggravated DUI, an offense that carried a mandatory minimum prison term of six years and a maximum of 30 years, according to Kane County court records.

Judge Thomas Stanfa accepted the plea, in which prosecutors dismissed a less serious charge of driving while his license was revoked in exchange for the guilty plea. Calleros also must pay a fine of $2,535, records show.

Calleros was arrested in Carpentersville on DUI charges in November 2013 and January 2014, police said. While free on bail, he was arrested on felony charges of possession of a controlled substance in November 2014.

It was then that authorities learned of Calleros' other previous DUI arrests and upgraded the charges against him, according to police.

Calleros had DUI arrests in March 2010 in Pulaski County, Illinois, along with September 2011 in McHenry County and October 2011 in Kane County, according to prosecutors. These three arrests resulted in a three-year prison term, of which he served half. He also was arrested in February 2004 and June 2004 in Harris County, Texas, on DUI charges and served jail time for both incidents.

Calleros contended police had no probable cause to pull him over in the November 2013 DUI arrest in Carpentersville, but Stanfa disagreed and said Calleros' protection against unreasonable search and seizure was not violated, court records show.

Under state law, Calleros can have his prison terms cut in half for good behavior. He also gets credit for nearly 15 months served at the Kane County jail while his cases were pending, so he could conceivably be released from prison in about a year and a half.
