Probation, fine in 30-pound West Dundee pot bust from 2013

A 45-year-old West Dundee man late last week was issued three years of probation for felony marijuana possession stemming from a domestic battery arrest in 2013.

Daniel L. Forcucci, of the 18N600 block of Woodcrest Lane, also must pay a drug fine of $5,000, which is the approximate street value of the marijuana, according to Kane County court records.

In exchange for the guilty plea, prosecutors dismissed more severe charges that carried a prison term of up to 30 years with no chance of probation.

A message left for Forcucci's defense attorney, Sam Amirante, was not immediately returned Monday.

According to the sheriff's department, deputies responded to a domestic incident at Forcucci's home in June 2013, noticed clues that he might be involved in drug activity and obtained a search warrant that netted more than 30 pounds of marijuana.

According to the sheriff's department, Focucci accused his then 27-year-old girlfriend of cheating on him, threw a doughnut in her face, kicked and punched her and used a hammer to break her phone - all in the presence of their young son.

Forcucci can be resentenced to up to 15 years in prison if he violates probation on the marijuana charge.

He also was charged with misdemeanor domestic battery and entered the county's pretrial diversion program for first-time offenders, records show.
