Appeals court upholds woman's reckless homicide conviction
INDIANAPOLIS (AP) - The Indiana Court of Appeals has upheld a woman's reckless homicide conviction in the death of a 5-month-old boy at a suburban Indianapolis day care.
But Friday's appellate ruling vacated Kirsten L. Phillips' involuntary manslaughter conviction after the court found her dual conviction violated double jeopardy principles.
Phillips was sentenced to 2ˆ½ years in prison in July for the January 2013 death of Conor Tilson at an unlicensed day care in Carmel. The child was found dead hours after being placed in a broken crib in a room with no adults and no baby monitor.
The Herald Bulletin reports (http://bit.ly/17lIKgp ) the court found Phillips was aware of the harm of using a faulty crib and acted in conscious disregard of the warning, but found her involuntary manslaughter represented double jeopardy.
