Police: Men recorded assault of woman

Elgin police arrested three men accused of sexually assaulting a woman and recording the assault on a cellphone, authorities said.

Eric Cruz, 23, of the 0-100 block of Dixon Avenue in Elgin, Daniel Hernandez-Gutierrez, 20, of the 0-100 block of Dean Drive in South Elgin, and Jose L. Vasquez Jr., 18, of Longwood Circle in Elgin, were being held in the Kane County jail on charges of unlawful restraint and multiple counts of criminal sexual assault, records show.

Vasquez and Hernandez-Gutierrez also were charged with kidnapping.

Cruz appeared in Kane County bond court Tuesday morning after being arrested Dec. 12, 2014, on a Cook County warrant, Elgin Police Cmdr. Ana Lalley said. His bail was set at $268,000.

Elgin police arrested Hernandez-Gutierrez Dec. 19 and Vasquez Jan. 9. They were being held on $250,000 bail and $1 million bail, respectively.

The woman, who sought treatment at Advocate Sherman Hospital, said she was assaulted in the early morning hours of Dec. 10 by the men, whom she knew, at an apartment on North Grove Avenue in Elgin, a police report states.

The woman, whose age is unknown, said she had four drinks but didn't consent to having sexual contact with the men nor being recorded, the report states. She said one of the men prompted her to drink faster, and she left her drink unattended several times.

She woke up in the morning with her clothes undone and bruises and pain to her back, the report states. She did not remember having sexual intercourse with anyone.

Police reviewed the video, which shows the woman incoherent on the floor while Vasquez and Hernandez-Gutierrez assaulted her; Cruz recorded the assault while narrating on camera, the report states.

The men used gang-related language during the assault, police said.
