No charges to be filed in deadly Illinois home invasion case
LENZBURG, Ill. (AP) - An investigator says charges won't be sought against a southwestern Illinois homeowner who shot and killed a man he said was trying to break in to his house.
St. Clair County sheriff's Capt. Scott Weymouth tells the Belleville Democrat (http://bit.ly/1F9pONx) a review of the case found no probable cause to seek prosecution of the Lenzburg-area homeowner in the death of David Shemonia Jr. of New Athens.
Authorities have said dispatchers received a call Jan. 13 from a man who reported he fired shots at someone he said was trying to break in to his house. Shemonia was found dead outside the home.
Shemonia's aunt, Judy Gamble Krauss, criticized the decision not to prosecute the homeowner. She says investigators never questioned neighbors who told relatives they heard arguing before the shots.
