2 charged with beating girl, stealing her pot in Batavia

Two Batavia residents are accused of beating a 16-year-old girl and stealing marijuana from her, according to police.

Tanner J. Smith and Desiree L. Smith, both 21 and living at the same address on the 700 block of North Van Buren Street, were charged Thursday with robbery, mob action and battery, records show.

The girl told police she was attacked just before 8 p.m. Oct. 7 while walking in the 1000 block of Pine Street in Batavia.

A vehicle pulled alongside her, two people got out and started hitting her, and Desiree L. Smith took a bag of marijuana from her, according to the police report. The duo then drove away.

The teen recognized the pair as former acquaintances, police said.

Both were being held at the Kane County jail. Bail is set at $12,500 for Tanner J. Smith and $10,000 for Desiree L. Smith, according to the sheriff's inmate log. Their next court date is Wednesday.

The matter of the girl having marijuana is being handled at the local level by the police department, according to police.
