Ex-Wheaton North Booster president sentencing delayed fourth time

DuPage County prosecutors sought a 120-day jail term and two years of probation for the former Wheaton North High School Booster Club president who pleaded guilty to stealing more than $11,000 from the organization.

But Judge Daniel Guerin on Friday said he needs time to read more information about the case against Dorothy "Dee" Horky, 58, of Winfield, He said he will impose his sentence at 8:30 a.m. Sept. 29.

Assistant State's Attorney Diane Michalak sought the jail sentence, saying Horky took 50 unauthorized cash advances totaling $10,985.53 between July 2012 and November 2012. She also made 26 withdrawals, totaling $9,838.32, from a club bank account that she had access to and transferred that money to pay for the cash advances she had taken on the credit card.

"She told investigators she got into a jam and made a mistake," Michalak told Guerin. "I would argue she made that mistake 76 times over an eight-month period."

Horky's attorney, Tim Martin, said his client is remorseful and embarrassed by her actions and already has made full restitution. He is seeking a sentence of probation and community service for Horky.

Her family, he said, was in a bind, with more than $40,000 in credit card debt and college tuition costs for their son.

"She has tried to commit suicide at least twice over this case," Martin told Guerin. "How much more remorseful can you get then to attempt to end your own life?"

Horky's sentencing hearing previously was delayed three times, as she failed to appear for court. Following her most recent absence from court, before which she threatened to harm herself, Horky was taken for mental health treatment at Central DuPage Hospital.

After her release Wednesday, she turned herself into DuPage County jail where she is now being held on a no-bail warrant.
