Wrongful death suit filed in Northern Indiana hit-and-run

SOUTH BEND, Ind. - The parents of a man killed in a hit-and-run accident while waving traffic away from another man who had just been fatally struck by a vehicle near South Bend have filed a lawsuit against the teenage driver charged with leaving the scene and his parents.

The South Bend Tribune reports the lawsuit filed by David and Sandra Fordyce, the parents of 49-year-old David Fordyce, seeks damages for what they contend was negligence and recklessness by the 17-year-old driver from Niles, Mich.

An attorney for the defendants is not listed in court papers. The teenager's criminal defense attorney, Amy Griner, declined comment.

A motion to move the teenager's criminal case to adult court is set for April 25. Fordyce was struck on March 24.
