Carpentersville man faces fifth DUI charge
A 28-year-old Carpentersville man faces prison time after being arrested and charged with his fifth DUI after he was found passed out at a gas station, according to court records and police.
Emmanuel Maldonado, of the 0-99 block of Thrush Road, was arrested by South Elgin police and faces four to 15 years in prison on the felony charge of aggravated DUI, records show.
South Elgin Police Detective Sgt. Mike Doty said authorities were called at 1:38 a.m. Sunday to a gas station on the 900 block of North La Fox Street (Route 31) for a suspicious vehicle. The gas station clerk told police a 2007 white Jeep Cherokee Laredo had not left a gas pump.
“The defendant's vehicle had been parked there for an hour. The defendant was passed out in the driver's seat of the vehicle,” Doty said.
Doty said by the time police arrived, Maldonado had apparently crawled into the rear of the vehicle and was sleeping there. When officers woke Maldonado, he smelled of alcohol, had slurred speech and thought he was in Carpentersville, Doty said. Maldonado began to take field sobriety tests, but could not complete them. He refused a breath test.
According to court documents, the incident was Maldonado's fifth DUI arrest.
He spent 30 days in jail after pleading guilty to a March 2011 DUI in Carpentersville, according to Kane County court records.
He also was sentenced to the maximum 364 days in jail after a misdemeanor DUI arrest and conviction from an August 2008 arrest in Carpentersville. Maldonado served 162 days of that sentence because he was eligible for time off because of good behavior, records show.
He also was arrested on charges of DUI and marijuana possession in Elgin in January 2004 and sentenced to 17 months supervision, alcohol treatment and 50 hours of public service, records show.
Maldonado's other arrests include driving while license suspended, obstruction justice, and disorderly conduct.
Maldonado, who is due in court April 5, posted $2,500 bond Monday night, according to the Kane County Sheriff's Office. While out on bond, he must wear an alcohol monitoring bracelet.
Maldonado also faces felony charges of driving on a suspended or revoked license for at least the fourth time, records show.
