Aurora man accused of dealing near public housing

An Aurora man was being held on $1 million bail and faces prison time after being arrested this week on charges he was dealing drugs near a public housing complex.

Tomy J. Kirby, 27, of the 900 block of Second Avenue, faces charges of armed violence, delivery of a controlled substance near a public housing complex, delivery of less than 15 grams of a controlled substance, two counts of possession of a controlled substance, and possession of a firearm without a valid Firearms Owners Identification Card, according to court records.

The most serious charge — that Kirby was armed with a .38-caliber pistol while in possession of heroin — carries a 6- to 30-year prison term without the possibility of probation.

He was arrested this week and is next due in court on March 31.

According to court records, Kirby pleaded guilty to felony kidnapping May 11, 2005 in exchange for charges of domestic battery, unlawful restraint and aggravated fleeing being dropped stemming from an Oct. 2, 2004 incident.

Kirby was sentenced to 50 months in prison for that offense.
